Kent Feet of fines (1257 to 1263)

The following are extracts relating to Wateringbury from Kent Records Volume XV published by Kent Archaeological Society. Entries on the Curia Regis Rolls suggest that the 'fines' concluded litigated disputes (before a royal court rather than just a manor court) rather than just the simple transfer of land as the expression feet of fines can mean

Quindene of St. Michael [13 Oct]Q. (pet. ) Hamo Crevequer. D. (ten.) Bartholomew de Otingebery; 32 ac. of land in Otringeber. Recognizance of the Grand Assize. D. acknowledged land to be the right of Q. and moreover granted to Q. the homage and all service of Simon le Monger [?] and his heirs for all tenement which Simon holds of D. in the same vill. And for this Q.granted to D. a moiety of the said land lying everywhere towards the west. To hold to D. and his heirs of Q. and his heirs, rendering yearly at Easter a barbed arrow. Warranty by Q. and his heirs. The other moiety and the said homage and services remain to Q. and his heirs to hold of the chief lords by the service thereto belonging.

Yalding; Wateringbury

Three weeks from Easter [29 April 1257] Q. John de Lynleg. D. Bartholomew de Otringebyr; concerning this that Q. complained that D. unjustly exacted custom and service of Q. for 13 ac. of land which Q. holds of D. in Ealding, to wit , suit to the court of D. at Otringbyr’ from three weeks to three weeks, whereof there was a Plea. D. acknowledged the said premises to be the right of Q. To hold to Q. and his heirs of D. and his heirs paying yearly 18 d., at Easter and Michaelmas , for all service of court, custom and exaction. Warranty by D. and his heirs. And for this Q. quitclaimed from himself and his heirs all his right in 2 ac. of land in the same vill which are called west Bynne to D. and his heirs.

Wateringbury. Octave of the Holy Trinity [10 June 1257] Q. William de Molendino. D. (imp) Batholomew de Otryngebyr’; a messuage, 10 ac. of land and the moiety of a mill in Otryngebyr’. Plea of Warranty of Charter. D. acknowledged the premises to be the right of Q. of the gift of D. To hold to Q. and his heirs of D. and his heirs , paying yearly at Easter 1d. and doing a scutage of 40 s., 2s and for more, more , and for less, less. Warranty by D. and his heirs. Q gave 20s.

Wateringbury. At Canterbury. Same date [27 Jan 1263]Q. Bartholomew de Ottrigebir’. D. Fulk de Scerstede; concerning the customs and services which Q. exacted from the free tenement which D. holds of Q. in Ottringebir, to wit 25 ac. of land. Q.exacted the service of a sixth of a knight’s fee , 25 d. to castleguard of the castle of Rochester and suit at the court of Q. of Otringebir’ from three weeks to three weeks, which service D. did not acknowledge. Recognizance of the Grand Assize.D. granted for himself and his heirs that they henceforth would do the service of the 20th part of a knight’s fee. And moreover D. granted to Q. 6s. 8d. of rent in Ottringebir’. To hold to Q. and his heirs of the chief lords doing all the service thereto belonging. And for this Q. for himself and his heirs quitclaimed to D. and his heirs all the right that Q. had in the said service mentioned above and in all other services due for the tenement.
