White v, Boorman.

—A plaint for the recovery of £4 6s. 10d. on the part of Mr White, farmer of Wateringbury, against defendant, butcher of the same place, for the sale of mutton. Plaintiff said that defendant was the habit of purchasing a sheep at the time, and the debt was the balance of an account of £28 6s. 10d. Defendant had paid £24 off. His Honour thought the summons should have been for sheep and not mutton. Plaintiff explained that the sheep were killed, and the mutton weighed. It was by the weight he sold. Defendant, in answer to his Honour, said that he was indebted to plaintiff for some amount, but did not know how much. His Honour—What do you dispute ? Defendant—The correctness of his account His Honour—What item ? Defendant—l don't know. His Honour—Now, how much do you say you owe ? Defendant —I don't know ; somewhere about £3 10s. His Honour—You don't know. You don't dispute any item, and then say you owe something like £3 10s. without knowing. I shall make order for the full amount of £4 6s. 10d.
