Fan^Forest Hills Coordinating Committee Meeting Minutes

October 1, 2014, Lake Oswego Adult Community Center

Committee members attending: C. Ockert, K. Ockert, D. Rudawitz, S. Gustafson, M. Monto, G. Lowe, D. Condra, M. Meneghin, C. Clee, J. Bolland, D. O’Neil

Guests: Natalie Cromarde, J. Gudman

Agenda:

A. Candidate Night Updates: October 9th, 6:00pm to 8:00 pm at the LO ACC. Postcards sent out. Will send out invites to neighborhood chairs.

B. Reports and Updates:

    • Treasury: $389.11; $64 spent on new printed LO City Code and a $100 donation was made

    • C. Ockert report on neighborhood code issues:

    • 1. 9th and C lot, Doug Fir was to be cut down to make room for steps off front porch. After contact with staff and filing of appeal to DRC the builder has reconsidered and will re-locate the steps and spare the tree.

      • 2. 10th and F lot to be built on with “front” porch on side of house which is not legal by code in R6. Planning staff is maintaining its legality. CO to meet with City Atty’s and request that this permit and others be held off until City Council approves the new code language approved by the Planning Commission last month which requires front porch to be located on the narrow front lot line. Motion made to demand that City Planning staff to enforce code as written currently in regards to front porch location in R6. Seconded and passed unanimously.

      • Another motion was made to express committee concern to the City Manager and the Planning Director for approving the permit for 983 10th street which violates city code for placement of porches in R6. Seconded and passed unanimously. Committee wants this message related to the other neighborhood chairs.

      • 3. 9th and C house with large river rock and ditch along C in right of way. City engineering contacted in June regarding this as a hazard. City acknowledges this is a hazard. Builder is responsible for taking care of run-off on-site not public right of way. The work was not permitted or approved. City is working with a consultant, builder and homeowner to use this as a pilot project for other homes in the neighborhood. City contacted that we do not want this to be a pilot project in FAN.

      • 4. Multi-family housing and multiple duplexes in R2. Code is clear that multi-family (3 or more dwellings) goes through mini development process for review and “a duplex” does not. City is interpreting that “a duplex” can mean more than one duplex and thereby not a mini-development so this type does not require the multiple family type review process. In addition the City staff is trying to pass less expensive fees for multiple duplexes which will encourage this type of development. This interpretation specifically goes against the new comprehensive plan. Board consensus is that they feel that re-writing the code would not be helpful, that the current code addresses the situation adequately however it is not being followed.

      • 5. Kyra’s on 6th and A. Parking lot expanded, no buffer between the lot and the R6 lot was required. Opened up throughway from parking lot to 6th for possible drive through application.

      • City contacted and Planning responded that no buffer required, however B Williams contacted contractor who will install a fence.

      • 6. City Manager will designate the Sunningdale water tower property as a new City park this month. This will be a ministerial decision (although voted on and approved by the City Council already).

C. New Business:

    • Planning commission members will be touring the FAN and Forest Hills neighborhood later this month with CO and any other interested committee members. 2pm-4pm on October 26th.
