BYLAW P1245

Pursuant to Sections 890 (4) and 893 of the Local Government Act, notice is hereby given that the Regional District of Alberni‐Clayoquot Board of Directors has waived notice of Public Hearing and intends to consider second and third readings of the “Regional District of Alberni‐Clayoquot Zoning Text Amendment Bylaw P1245” at its regular Board of Director’s meeting to be held on Wednesday, January 27, 2010 starting at 1:30 pm in the Board Room at the Regional District of Alberni‐Clayoquot office located at 3008 Fifth Avenue, Port Alberni, BC.

Bylaw P1245:

The Regional District of Alberni‐Clayoquot Zoning Text Amendment Bylaw P1245, upon adoption, will amend the “Regional District of Alberni‐Clayoquot Zoning By‐law No. 15, 1971” by adding the following subsections to Section 143, Marine Recreation (MR) District to read as follows:

i) “143.3 (3) a) iii) a deck or decks with a maximum combined horizontal area of 1000 square feet.”

ii) “143.3 (3) b) iv) a deck or decks with a maximum combined horizontal area of 1000 square feet and one porch with a maximum horizontal area of 60 square feet.”

iii) “143.3 (3) e) “Deck” means a structure abutting a dwelling, with no roof or walls except for visual partitions and railings which is constructed on piers or foundations above‐grade for use as an outdoor living area.”

iv) “143.3 (3) f) “Porch” means a structure abutting a dwelling, having a roof but with walls that are open and unenclosed to the extent of at least 50% thereof except for removable screens.”

v) Renumbering section 143.3(2) i) and ii) to143.3(2) a) and b).

to facilitate the construction of decks as well as legalize existing decks. Currently, only properties within Section 49, Barclay District (Salmon Beach) have this zoning and are therefore affected by this amendment.

Copies of the proposed bylaw and other relevant documents and information are available for inspection at the Regional District of Alberni‐Clayoquot office during normal office hours, 8:00 am until 4:30 pm, Monday through Friday, excluding statutory holidays, from January 15, 2010, until January 27, 2010 both inclusive.

Anyone wishing to make written submissions to the Regional District of Alberni‐Clayoquot with respect to this bylaw may do so by delivering the submission attention to Mike Irg, Manager of Planning and Development, 3008 Fifth Avenue, Port Alberni, BC. Written submissions received at the Regional District office by 4:00 pm, Tuesday, January 26, 2010 will be circulated to the Board of Directors prior to the meeting.
