TERMS AND CONDITIONS

General

Please read carefully before booking and we advise you to print a copy for your reference.

Bookings made more than eight weeks in advance require a 25% non refundable deposit at the time of booking. The balance of the holiday cost, ie the published price less the deposit paid, is due eight weeks before the holiday starts.

Holidays starting less than eight weeks from booking require payment of the holiday in full

A refundable deposit of £150 is payable eight weeks before the holiday which will be held against damage and non return of house keys. This will be returned at the owners discretion within 14 days of the end of the holiday.

A booking fee of £30 is payable at the time of booking

The booking will be confirmed in writing by the owners.

The owners reserve the right to refuse a booking under any circumstances.

If the balance is not received by the due date the owners reserve the right to cancel the accommodation as per the conditions of cancellation.

The swimming pool will be available for use between 26th May 2023 and 29th September 2023. Pool heating is available at an extra optional charge of £200. Every effort will be made to heat the pool to 28deg but no liability will be accepted if the temperature does not achieve this due to equipment failure, adverse weather conditions or due to the solar cover being left off for extended periods.

Booking Conditions

This hire agreement is between you ,the hirer and Ken and Chris Beaumont, the owners. The accommodation is let for the number of people supplied at the time of booking only totalling a maximum of eight people (excluding babies). The name of each occupant must be provided at the time of booking together with the ages of those under eighteen years of age and there is no alteration allowed to this list without prior consent. Please note that the swimming pool , the Lodge and its facilities is for the use of those named at the time of booking only.

The hire agreement confers upon the hirer the right to occupy Treloyhan Lodge for a holiday , of up to two weeks in duration and as specified at the time of booking, within the meaning of Schedule 1 Paragraph 9 of the Housing Act 1988.

Should the booking conditions not be met the hirer agrees to pay any additional charges incurred and the owners reserve the right to re enter the property and terminate the tenancy.

The owners do not accept bookings from all male or all female parties more than two in number or for groups of single persons under the age of thirty years without prior arrangement.

If due to any occurrence beyond the owners’ control and in the opinion of the owners the accommodation is not available as booked eg fire, flood other damage rendering the property unfit for letting, all monies will be repaid in full for those days Treloyhan Lodge is unavailable and the hirer will have no further claim against the owners. Should the swimming pool in the opinion of the owners be unavailable for swimming due to causes beyond the owners' control a refund will be made equal to £40 for each day the pool is unavailable.

The owners reserve the right to amend prices/descriptions due to errors/omissions.

The car parking provided is entirely at the hirers’ own risk.

The owners cannot accept liability for events that occur outside their control, such as normal breakdown of domestic appliances, plumbing, wiring and damage resulting from exceptional weather conditions. Once advised of a problem the owners will take immediate action to try to affect a speedy solution, minimising any inconvenience caused.

Problems should be reported as soon as possible. The owners cannot accept any responsibility for complaints not drawn to their attention until departure.

Children must be supervised at all times around the pool by an adult who can swim and there are lockable gates and door and fencing to allow the hirer to control access. The hirer must not allow anyone to step on the pool cover under any circumstances as this can be extremely dangerous. The pool cover must be completely removed before anyone enters the swimming pool. Diving into the pool is not allowed.

The hirer must observe any general rules and regulations applying to the property. These include inter alia 1. the removal of outside footware when in the property 2. no smoking in any inside rooms 3. no animals or pets in the lodge itself or in the grounds 4. no barbeques whatsoever.

Please note the upper bunk bed must not be used by any child under 6yrs of age and anyone using the upper bunk bed should be advised not to lean over the guard rail. The fireplace in the upstairs bedroom is for decoration only and fires must not be lit in it. The chimney has been completely removed to this fireplace and fires lit here will spread to the general house fabric.

The hirer must do nothing to make void or voidable any policy of insurance, must not cause a nuisance to neighbours and must allow the owners, their servants or agents reasonable access.

The property must be vacated by 10am on the day of departure and all keys left on the dining table. Late departure may incur an extra charge.

Arrivals are permitted from 4pm. Arrivals before this time are only accepted by prior arrangement.

All accommodation must be kept and left in a clean and tidy state both inside and outside with all furniture returned to the place where it was found as per the hirer’s arrival. No inside furniture must be taken outside.

The owners reserve the right to withhold part of the damage deposit towards extra cleaning costs where a property has not been left in a reasonable condition or where services provided such as electricity and gas have been abused.

The property is fully checked between lettings and any damage to the property or equipment is fully chargeable to the hirer.

The hirer's liability is not limited to the damage/loss deposit.

Personal property belonging to the hirer is brought into Treloyhan Lodge at the hirer's own risk and no responsibility can be accepted for loss or damage for such items.

Breach of any of these conditions shall entitle the owners to resume possession forthwith.

Cancellation

In the event of cancellation for any reason the owners will make every effort to re-let the property. If the owners do so they will refund the difference between the payment received from the hirer and that received from the substitute booking less a £50 administrative fee and the booking fee.

If they are unable to re-let the property the hirer will become liable for the full cost of the holiday.

The owners recommend that the hirer takes out insurance to cover costs such as losses, damage to personal possessions and cancellation.

The owners do not accept liability for any act, neglect or default by any person whether or not within their employ or otherwise under their control, nor for any accident, damage, loss, injury, expense or inconvenience, whether to person or property which the hirer or any other person may suffer or incur arising out of, or in any way connected with the letting.
